1. Introduction & Acceptance
These Terms of Service ("Terms") govern your access to and use of the website available at onlinepsychologystudies.com (the "Website"), the "Online Psychology Studies" application (the "Application"), and all related features, content, assessment tests, reports, subscriptions and services offered through them (collectively, the "Services"), provided by Aura Health LLC, a limited liability company incorporated under the laws of the United States of America (the "Platform Operator", "we", "us" or "our"). The Platform Operator develops, owns, licenses, operates and maintains the Application and is responsible for its overall operation, functionality, content, quality and legal compliance, as well as for payment collection, billing and subscription management where applicable.
The Terms constitute a legally binding agreement between you ("You", "Your" or "User") and the Platform Operator. By accessing the Website, completing any test, creating an account, purchasing a trial or subscription, or otherwise using the Services, You acknowledge that You have read, understood and agree to be bound by the Terms. If You do not agree, You must not access or use the Website, the Application or the Services.
You are solely responsible for ensuring that your device meets the minimum technical requirements necessary to access the Application, including a compatible operating system and internet connectivity. We are not responsible for any inability to access the Services due to device incompatibility, technical limitations or connectivity issues on your end.
2. Eligibility
2.1. You must be at least eighteen (18) years old, or have reached the age of legal majority in your jurisdiction, to access or use the Services, create an account, or purchase any trial or subscription.
2.2. By using the Services you represent and warrant that you meet the applicable age requirements, have the legal capacity to enter into a binding agreement, and that your use of the Services complies with all applicable laws and regulations.
2.3. The Services are not intended for use by children. We do not knowingly collect personal data from individuals under the age of eighteen (18). If we become aware that personal data of a minor has been collected without appropriate consent, we reserve the right to delete such information and terminate the associated account.
3. Data Protection & Privacy
3.1. We take your privacy and the protection of your personal data seriously. The collection, use, disclosure and protection of personal information in connection with your use of the Services are governed by our Privacy Policy, which forms an integral part of these Terms.
3.2. Our Privacy Policy explains what information we collect, how and why we process it, how it is protected, and the rights available to you under applicable data protection laws — including how your responses are de-identified and kept confidential.
3.3. By accessing or using the Services, completing any test, creating an account, or purchasing a trial or subscription, you acknowledge that you have read, understood and agree to the practices described in the Privacy Policy.
4. Confidentiality & Anonymity
Your responses are confidential and anonymised. Online Psychology Studies operates entirely online and is designed so that individual responses are never displayed on their own, never sold, and never published in a form that could identify you.
4.1. All assessment responses you submit are treated as confidential. Direct identifiers (such as your name and email) are stored separately from your assessment responses and are not required to participate in the underlying research.
4.2. Before any response data is used for analysis, comparison or publication, it is de-identified and aggregated with data from other Users. Any shared, compared or published output reflects population-level statistics only — averages, distributions and percentile bands — and does not permit the identification of any individual.
4.3. We implement appropriate technical and organisational measures to protect your information against unauthorised access, disclosure or misuse, and we restrict access to identifiable data to those who need it to operate the Services.
4.4. Because the platform is fully online, you may participate from anywhere. Your participation, and the confidentiality and anonymity protections described here, do not depend on your location.
5. Your Use of the Service
5.1. Subject to your compliance with the Terms, the Platform Operator grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Services solely for your personal, non-commercial use. This licence grants no ownership or other proprietary interest.
Account registration and security
5.2. Access to certain features may require you to create an account (the "Account"). You are solely responsible for maintaining the confidentiality and security of your Account credentials and for all activity conducted through your Account. You agree that all information you provide is accurate, complete and kept up to date, and that you will not impersonate any other person or misrepresent your affiliation.
5.3. If you believe your Account has been accessed without authorisation, you must notify us immediately at support@onlinepsychologystudies.com. We reserve the right to suspend, restrict or terminate your Account if we reasonably suspect unauthorised use, fraud, security breaches or violations of the Terms.
How the Services work
5.4. The Services enable Users to complete digital assessment tests and receive personalised reports generated automatically from their responses (the "Report(s)"). Reports and test results are provided for informational, educational and research purposes only and are generated automatically based on the information you provide.
5.5. You agree to use the Services only for lawful purposes and to provide accurate information. You are solely responsible for any decisions or actions you take based on Reports or other outputs generated through the Services.
Prohibited uses
5.6. You agree not to misuse the Services. Prohibited conduct includes, without limitation: creating multiple Accounts; transferring or selling an Account; accessing the Services through another User's Account without authorisation; providing false or misleading information; scraping, harvesting or collecting data through automated means; reverse engineering or attempting to derive source code; uploading malware; interfering with the integrity, performance or security of the Services; or violating any applicable law or third-party right.
5.7. Any violation of this section may result in the immediate suspension or termination of your Account, without prejudice to any other rights or remedies available to us.
6. Fees, Trial & Subscription Plans
6.1. Certain parts of the Services are offered for a fee (the "Fees"). All applicable Fees are disclosed to you before purchase, including during checkout. By providing your payment information and completing a purchase, you authorise the Platform Operator to charge your selected payment method for all applicable Fees, including any recurring subscription charges.
6.2. You agree to provide current, complete and accurate payment information. Any currency conversions, foreign transaction fees or additional charges imposed by your payment provider are your sole responsibility. We reserve the right to correct any pricing errors and, where applicable, to cancel or adjust the affected transaction.
6.3. Where a paid trial or subscription is offered, the applicable fee, duration and renewal terms are disclosed at checkout. Unless you cancel before the end of a trial or subscription period, access may continue under an automatically renewing subscription, and your payment method will be charged for each subscription period until you cancel. We will provide reasonable advance notice of any change to subscription Fees.
6.4. If a payment is declined, we may attempt to reprocess it using the same payment method. During any re-attempt period your access may be temporarily restricted, and you remain responsible for all outstanding Fees.
7. Cancellation
7.1. You may cancel a trial or subscription at any time before the end of the applicable period, either through the "Cancel Subscription" function within your Account or by contacting support@onlinepsychologystudies.com using the email address associated with your Account.
7.2. To avoid being charged for the next period, cancellation must be completed before the end of the current period. Upon cancellation, access remains available until the end of the current period, after which no further recurring charges apply. Cancellation does not automatically delete your Account; Account deletion may be requested separately (see the Privacy Policy).
8. Refund Policy
8.1. Trials and subscriptions are digital services made available immediately after purchase. Except where required by applicable law, all purchases are final and refunds are not guaranteed. Any refunds are granted solely at our discretion on a case-by-case basis.
8.2. If you believe you are entitled to a refund, contact support@onlinepsychologystudies.com with the email address associated with your Account, details of the purchase, and the reasons for your request. We do not offer partial refunds or credits for unused time within a paid period, except where required by applicable law.
8.3. Initiating a chargeback or payment dispute for a validly authorised transaction without first contacting support may result in suspension or termination of your Account and does not guarantee a refund.
9. Research & Academic Use of Data
Online Psychology Studies exists to support academic research. Data collected through the Services is used to advance psychological knowledge — in confidential, de-identified and aggregated form only.
9.1. The platform is provided for informational, educational and research purposes. By using the Services, you acknowledge that a primary purpose of the platform is the advancement of psychological knowledge and the facilitation of academic study into human behaviour, cognition and related fields.
9.2. As part of these purposes, the Platform Operator conducts ongoing academic studies and analysis using data collected through the Services — including assessment responses, metric data and anonymised test results (collectively, the "Research Data"). Such research is conducted in accordance with applicable data protection laws and recognised ethical research standards.
9.3. The Services may include a shared-response feature through which aggregated, anonymised data is displayed, allowing Users to see how their responses compare with broader patterns. All data presented through this feature is anonymised before sharing; no personally identifiable information is disclosed. By submitting responses, you agree that your anonymised, de-identified response data may be included in aggregated research outputs and comparisons.
9.4. Research Data is used for academic and scientific research, the development and validation of assessment tools, statistical analysis, the publication of findings in academic or educational contexts, and the improvement of the Services. Research Data is never sold to advertisers, data brokers or commercial third parties. It may be shared with academic partners or research collaborators solely for legitimate research purposes, subject to appropriate confidentiality and data-protection safeguards.
9.5. Where research findings are published or shared externally, they are presented in aggregated or anonymised form only, in a manner that does not permit the identification of any individual. Your participation does not entitle you to compensation, royalties or any share of research outcomes or resulting intellectual property.
10. Not Healthcare Advice
10.1. The Services, including all tests, Reports and related content, are provided strictly for informational, educational and research purposes only. While the assessments draw on psychological frameworks, they are not clinical tools and should be viewed as instruments for self-discovery, education and research. The Services do not constitute, and are not intended to replace, medical, psychological, psychiatric, diagnostic or therapeutic advice, diagnosis or treatment.
10.2. You should always consult a qualified physician or licensed healthcare professional before making decisions regarding your health, and you should never disregard, delay or avoid seeking professional advice based on information provided through the Services. Any reliance on the Services or Reports is solely at your own risk.
10.3. Any reviews, comments or ratings made available through the Services reflect only the personal opinions of the individuals who submitted them, do not represent the views of the Platform Operator, and should not be considered medical advice.
11. Intellectual Property
11.1. All rights, title and interest in and to the Services — including the Website, the Application, assessment tests, methodologies, questions, scoring logic, Reports (including their structure and presentation), software, text, graphics, logos, trademarks and all related materials (collectively, the "Intellectual Property") — are owned by or licensed to the Platform Operator and are protected by applicable intellectual property, trademark and copyright laws.
11.2. The name "Online Psychology Studies" and all related brand elements are the exclusive property of the Platform Operator and may not be used, reproduced or displayed without prior written consent. Except for the limited licence expressly granted to you, nothing in the Terms grants you any right, title or interest in any Intellectual Property.
11.3. You retain ownership of the information you voluntarily submit when completing assessments. By submitting such information, you grant the Platform Operator a non-exclusive, worldwide, royalty-free licence to use, process, store and analyse it solely for the purposes of providing, operating, maintaining, improving and securing the Services, generating Reports, conducting the research described in these Terms, complying with legal obligations and enforcing the Terms.
11.4. If you submit any feedback, suggestions or ideas regarding the Services ("Feedback"), you grant the Platform Operator a perpetual, irrevocable, worldwide, royalty-free and sublicensable licence to use and incorporate such Feedback without compensation, attribution or restriction.
12. Third-Party Websites
12.1. The Services may contain links to third-party websites, services or content not owned or controlled by the Platform Operator. We do not control, endorse or assume responsibility for any third-party websites, including their content, accuracy, availability, privacy practices or terms. Accessing them is done at your own risk and is governed solely by the terms and policies of those third parties.
13. Disclaimer of Warranties
13.1. To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis, without any representations or warranties of any kind, whether express, implied or statutory.
13.2. The Platform Operator expressly disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any results or Reports will be accurate, complete or suitable for your needs. Any use of the Services is at your sole risk.
13.3. Some jurisdictions do not allow the exclusion of certain warranties; to the extent such exclusions are not permitted, the above disclaimers apply only to the maximum extent permitted by law.
14. Limitation of Liability
14.1. To the fullest extent permitted by applicable law, in no event shall the Platform Operator or its directors, officers, employees, agents, affiliates, licensors or service providers be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including loss of profits, data or goodwill, arising out of or relating to your use of, or inability to use, the Services, even if advised of the possibility of such damages.
14.2. To the maximum extent permitted by law, the total aggregate liability of the Platform Operator for any claim arising out of or relating to the Services or the Terms shall not exceed the greater of (a) USD 100, or (b) the total amount paid by you for the Services during the thirty (30) days immediately preceding the event giving rise to the claim.
14.3. Nothing in the Terms excludes or limits liability for gross negligence or wilful misconduct, death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law. For Users in the European Union, the European Economic Area or the United Kingdom, these limitations apply only to the extent permitted by mandatory consumer-protection laws.
15. Indemnification
15.1. To the fullest extent permitted by applicable law, you agree to indemnify, defend and hold harmless the Platform Operator and its officers, directors, employees, agents, affiliates, licensors, service providers, successors and assigns from and against any and all claims, demands, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or relating to your access to or use of the Services, your violation of the Terms, your misuse of the Services or Reports, or your infringement of any third-party rights. This obligation survives the termination of the Terms.
16. Dispute Resolution & Governing Law
Please read this section carefully. It affects how disputes are resolved.
16.1. Informal resolution. Most concerns can be resolved informally. Before initiating any formal proceedings, you agree to first attempt to resolve any dispute, claim or controversy arising out of or relating to the Terms (each, a "Claim") by contacting us at support@onlinepsychologystudies.com, including your contact details, a description of the Claim, and the relief sought. If the Claim is not resolved within sixty (60) days, either party may proceed as described below.
16.2. Governing law. The Terms, and any Claim arising out of or relating to the Terms or the Services, are governed by and construed in accordance with the laws of the United States of America, without regard to conflict-of-law principles. This choice of law does not deprive consumers of any mandatory rights or protections afforded under the laws of their country or state of residence.
16.3. Individual basis. To the fullest extent permitted by applicable law, all Claims must be brought solely in an individual capacity and not as a plaintiff or class member in any class, collective or representative proceeding. Where applicable law does not permit such a waiver, any permitted Claim shall be limited strictly to your individual relief.
16.4. EU online dispute resolution. If you are a consumer residing in the European Union, you may, where applicable, submit a complaint through the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Participation is voluntary and does not affect your statutory rights.
17. Modifications, Severability & Miscellaneous
17.1. We reserve the right to modify or update the Terms at any time. Changes will be posted on the Website and the "Last updated" date revised accordingly. Changes become effective upon posting unless stated otherwise. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
17.2. The Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and the Platform Operator and supersede all prior agreements regarding your use of the Services.
17.3. If any provision is held invalid or unenforceable, it shall be severed to the minimum extent necessary and the remaining provisions shall remain in full force and effect. Our failure to exercise any right shall not operate as a waiver. You may not assign your rights or obligations without our prior written consent; we may assign ours without restriction, including in connection with a merger, acquisition or sale of assets.
